The Real Estate Settlements Procedures Act is a law that was passed by the U.S. Congress in 1974 in order to protect homeowners. The goal of the act is to make sure homeowners are educated when it comes to real estate services. The protections provided to consumers are meant to keep them from being taken advantage of during this time and making it so the real estate agent or loan servicer must abide by the regulations set forth by RESPA.

Some of the protections provided under RESPA include:

  • Loan servicers may not provide consumer reporting agencies specific information regarding overdue payments during the 60-day qualified written request.
  • Persons are prohibited from accepting or giving anything that would constitute as value for a referral of the settlement service business regarding mortgage loans.
  • Persons are prohibited from giving or receiving kickbacks.
  • Sellers of a home are prohibited from setting forth requirements that the buyer use a specific company for settlement services as part of a condition of sale.

For instance, violations of Section 8 of RESPA are subject to both criminal and civil charges, as well as fines reaching up to $10,000.
