Identifying Unlawful Phone Calls

|

Every day, a countless number of Americans receive unwanted phone calls to their phones from banks, debt collectors, and other companies. However, this act is considered unlawful under the Telephone Consumer Protection Act, which states that persons must give their consent to receive these types of calls from companies. If an individual receives an unwanted call from a debt collector or various other types of companies, the individual may be entitled to collect up to $1,500 for each call.

What are Robocalls?

Robocalls are those phone calls produced using autodial systems. In most cases, these phone calls are designed with pre-recorded messages, which play when the consumer answers the phone. However, a call can also be considered a robocall if a live person speaks when the consumer answers but the call is made using an autodial system.

What are Autodial Systems?

Autodial systems are pieces of software or equipment that dial telephone numbers without any human initiation or intervention. In most instances, if a person receives a phone call and is greeted by a message that has been pre-recorded, that phone call was more than likely made using an autodial system. Additionally, many of these types of phone calls result in a disconnect or a period of silence before a live human speaks.

Texts Are Unlawful, Too

Creditors have also adapted to the changing times and are known to send texts to American phones, which is also considered illegal whether they identify themselves as debt collectors or not. You’re in no way obligated to reply to any received messages or texts, especially when they’re from people who refuse to identify themselves. If you receive a suspicious text, call our consumer rights attorneys to investigate your situation and determine a next course of action.

Our team focuses on protecting your rights under the following laws:

  • Telephone Consumer Protection Act
