Attorney James Vlahakis of Atlas Consumer Law, Lead Counsel for Plaintiffs in a Class Action Lawsuit Against Apple, Inc.

On December 21, 2017, attorney James Vlahakis of Atlas Consumer Law, filed a nationwide class action lawsuit against Apple, Inc., which alleges that Apple purposefully engineered and released operating software updates to iPhones for the purpose of slowing down the performance speeds for older model phones to induce consumers to purchase newer model iPhones.

The Plaintiffs, Ala Abdulla, Lance A. Raphael, Sam Mangano, Ryan Glaze and Kirk Pedelty, allege that Apple’s software updates slowed down their iPhones to such an extent that they had to replace their iPhones with newer models. When Plaintiffs and others asked Apple for help, Apple representatives suggested that they upgrade to newer iPhone, rather than suggesting that they replace their iPhones’ batteries. Reports suggest that the replacement of older batteries would have allowed Plaintiffs and other consumers to continue to use their older model phones, even after the release of more sophisticated and updated software.

Plaintiffs allege that Apple’s failure to inform consumers that it was purposefully slowing down older iPhones, without suggesting the option of battery replacement to help speed up phones, were purposeful acts of deception. If proven, Apples’ actions have violated various consumer rights statutes, including, Illinois Consumer Fraud and Deceptive Business Practices Act, the Indiana Deceptive Consumer Sales Act, North Carolina’s Unfair and Deceptive Trade Practices Act, and virtually all state UDAP (unfair and deceptive acts and practices) statutes. Since the suit was filed consumers from various states (including Europe) have contacted Atlas Consumer Law, claiming been harmed and defrauded by Apple’s conduct.
